The Dutch Tax Authority's position on the fiscal treatment of shares returned by "bad leavers" is facing scrutiny. A bad leaver is an employee dismissed for culpable conduct who must return any share package previously granted by the employer. The Tax Authority issued guidance in April on how these returned shares should be taxed, but this stance is now being questioned by professionals in the field.
