Dutch courts are divided on whether employees in a "dormant employment contract" β€” where a worker remains employed but receives no pay after two years of sick leave β€” continue to accrue vacation days. A cantonal court in Dordrecht ruled that no new vacation days are built up once an employee has been incapacitated for more than 104 weeks. The ruling stands out as other recent cases involving similar circumstances have reached different conclusions.
